STATEMENT OF POLICY


Haiti Teen Challenge/HTC (the “Company”) is committed to protecting the privacy of its users. This Privacy Policy (“Privacy Policy”) is designed to help you understand what information we gather, how we use it, what we do to protect it, and to assist you in making informed decisions when using our service. Unless otherwise indicated below, this privacy policy applies to any website that references this privacy policy, any company website, as well as any data the company may collect across partnered and unaffiliated sites.
 
For purposes of this agreement, “service” refers to the company’s service, which can be accessed via our website at
www.haititc.org or through our mobile application. The terms “we,” “us,” and “our” refer to the company. “You” refers to you, as a user of the service.


I. CONSENT


ATTENTION: PLEASE READ THIS HAITI TEEN CHALLENGE PRIVACY POLICY (“PRIVACY POLICY”) CAREFULLY. THIS PRIVACY POLICY PERTAINS TO YOUR ACCESSING, DOWNLOADING, OR USING THE  HTTPS://WWW.HAITITC.ORG WEBSITE (THE “WEBSITE”), AND YOUR ACCESSING ANY ASSOCIATED CONTENT AVAILABLE THROUGH THE WEBSITE (TOGETHER THE “SERVICE”).


The Service is operated by Haiti Teen Challenge, 740 E. 24th St., Minneapolis, MN 55404 (“We” or “Haiti Teen Challenge”). This privacy policy describes the information collected through (“Your”) use of the Service, how we use it, how We share it, how We protect it, and the rights and choices you (“You”) have about your information.


ATTENTION: PLEASE READ OUR PRIVACY POLICY CAREFULLY BEFORE USING THE SERVICE. USING THE SERVICE INDICATES THAT YOU ACCEPT AND AGREE TO BE BOUND BY THIS PRIVACY POLICY IN FULL. IF YOU DO NOT ACCEPT THIS PRIVACY POLICY, DO NOT USE THE SERVICE. You acknowledge that (a) you have read and understood this privacy policy; and (b) for users within the European Union, in the event that any legal requirements of the European Union’s General Data Protection Regulation (GDPR) is determined to apply such that consent would be required, this privacy policy shall be deemed to have the same force and effect as a signed agreement; and (c) that by agreeing to this privacy policy, you consent to receive notifications regarding security incidents to the email address ee have on file for you, if any.


Unless explicitly stated otherwise, any new features that augment or enhance the current service shall be subject to this privacy policy.


Please review the privacy policy each time you use the service. BY USING THE SERVICE, YOU AGREE TO BE BOUND BY THE MOST RECENT VERSION OF THE PRIVACY POLICY. If we materially change this privacy policy in a way that materially affects your rights, we will let you know by sending an email notifying you of the changes to the email address We have on file for you, if any, and posting a notice about the revised privacy policy on the service.


II. INFORMATION WE COLLECT


We collect information from you when you use the service, contact or interact with us, fill out a form, and voluntarily provide us with your comments and other content in connection with using the service.


When You create and log into your account, subscribe to our blog, or manage your Subscription, we may collect your name, address, telephone number, telephone type, email address, password, birthdate, information related to how you heard about Haiti Teen Challenge, and information related to your impact, donations, and volunteering.


When you apply for a job or sign up for emails about new jobs, we may collect your email address, name, nickname, address, home telephone number, cell phone number, qualifications for the position (including information related to your skills, knowledge, experience, and interest and related information), gender, ethnicity, veteran or disability status. The job application process is run by a third-party service provider.


We may collect information about you from third-party sources. The Service provides links to our social media pages, including our Facebook, Instagram, LinkedIn, Vimeo, and YouTube Pages. If you connect with social media websites through the service, we may receive personal information about you. We may also receive information from other third-party providers.


We may combine all of the information we collect from or about you and use it in the manner described in this privacy policy.


III. HOW WE USE YOUR INFORMATION


Personal Information


  • We use the information that we collect for several purposes, including:
  • The purposes for which you provided it;
  • To provide information and services to you
  • To accept and process payments, including donations (your information will be used to submit your payment information to our payment processors);
  • To register fundraisers, and create complimentary fundraising pages;
  • To process employment applications;
  • To provide the products you ordered (including, but not limited to, confirming your order, processing and shipping your purchase, notifying you about updates to the service, and providing you with additional information about our products);
  • To process and respond to your inquiries and comments;
  • To create or add to your registered account;
  • To display relevant advertising;
  • To send you information about your relationship or transactions with us;
  • To administer, operate, and improve the service;
  • To personalize and enhance your experience using the service;
  • To send periodic emails. If you choose, the email address you provide may be used to send you occasional news, updates, etc. Note: If at any time you would like to unsubscribe from receiving future emails, we include detailed unsubscribe instructions at the bottom of each email;
  • To generate and review reports and data about our user base and service usage patterns;
  • To analyze the accuracy, effectiveness, usability, or popularity of the service;
  • To compile aggregate data for internal and external business purposes;
  • To prevent fraud and abuse of the service and to otherwise protect users and visitors and our organization;
  • To assist law enforcement and respond to subpoenas; and
  • To perform other business activities as needed, or as described elsewhere in this privacy policy.
  • As explained elsewhere in this privacy policy, personal information we collect may be processed by our partners in providing services related to the service (such as administration services, technical services relating to the maintenance, servicing, and upgrading of the products, software, hosting services, customer service, data migration services, and analytical services, among others).
     

Text messaging originator opt-in data and consent will not be shared with any third parties unless required by law.
 
If you are a Minnesota resident, we use your information in compliance with the MCDPA. We do not sell your personal information or use it for targeted advertising. If we ever choose to do so, Minnesota residents will have the right to opt out.


IV.           HOW YOUR INFORMATION IS DISCLOSED


Information may be disclosed to third parties in accordance with our privacy policy.


A.   MCDPA Consumer Rights (Minnesota Residents Only). The MCDPA provides you the following rights:

  • Rights of Access and Data Portability: You may request a copy of your personal data in a portable format.
  • Right to Correction: You may request correction of data that is inaccurate or out-of-date.
  • Right to Deletion: You may request deletion of your personal data, subject to legal or operational exceptions.
  • Right to Opt-Out: You may request that we refrain from any use of your personal data not necessary to fulfill our mission (e.g., analytics or internal reporting)
  • Right to Non-Discrimination: We will not deny you services, charge you different prices, or treat you less favorably for exercising any of these rights.


Certain data cannot be deleted if it is necessary for legal, financial, operational, or safety reasons. We may retain donation records, volunteer service history or financial transactions in order to:

  • Comply with tax and auditing obligations
  • Prevent fraud or abuse
  • Fulfill prior donations or merchandise orders
  • Maintain accurate impact reporting
  • Defend against potential legal claims


When we cannot delete specific data, we will explain the reason and, where possible, anonymize it to protect your privacy.

B.   Third-Party Service Providers and Business Partners. We may use third-party service providers and business partners to perform functions in connection with the service, such as social sharing, marketing, site analytics, relationship management, functions related to analyzing and improving the service usefulness, reliability, user experience, customer experience, and operation, storing data, and as otherwise described in this privacy policy. We also may share personal information with these providers and partners for their direct marketing and promotional purposes and so they can provide services to you.


C.   Advertisers. We may use third-party services to understand aggregate usage trends and improve our service. This data is used solely for internal purposes and not sold or shared for third-party advertising or profiling.
 
We do not use or permit third-party behavioral advertising platforms to target FMSC website visitors based on browsing activity. We do not sell, rent, or otherwise share your personal information with advertisers.


D.    Payment Processing. Any credit card information you provide may be shared with and may be stored by our payment processors for the purposes of processing your credit card payment and is subject to their privacy policies, including in the case of data breach. For more information, please see the privacy policies of the third-parties we use to process and maintain financial transactions:


E.     Analytics. We use analytics tools to better understand who is using the service and how people are using it. These tools may use cookies and other technologies to collect information about your use of the service and your preferences and activities. These tools collect information sent by your device or the service and other information that assists us in improving the service. This information may be used to analyze and track data, determine the popularity of certain content, and better understand your online activity, among other things.


F.     Cookies and Other Tracking Technologies. We, along with third parties, use cookies, local storage objects, web beacons, and other technologies. These technologies are used for tracking, analytics, and personalization and optimization of the service.


Cookies are small files that are transferred to and stored on your computer through your web browser (if you allow it) that enable the website’s or service provider’s system to recognize your browser and capture and remember certain information. You can instruct your browser to stop accepting cookies, but if you do not accept cookies, you may not be able to use all portions of all functionalities of the Service.

  • Persistent cookies remain on the visitor’s computer after the browser has been closed.
  • Session cookies exist only during a visitor’s online session and disappear from the visitor’s computer when he/she closes the browser software.


V. SECURITY


We implement a variety of security measures to protect the safety of your personal information when you enter, submit, or access your personal information.

 

While we take reasonable measures to protect the information you submit via the service against loss, theft, and unauthorized use, disclosure, or modification, we cannot guarantee its absolute security. No Internet, email, or mobile application transmission is ever fully secure or error free. Email or other messages sent through the service may not be secure. You should use caution whenever submitting information through the service and take special care in deciding with which information you provide us.

 

We cannot guarantee that transmissions of your personal information will be fully secure and that third parties will never be able to defeat our security measures or the security measures of our partners. WE ASSUME NO LIABILITY FOR DISCLOSURE OF YOUR INFORMATION DUE TO TRANSMISSION ERRORS, THIRD-PARTY ACCESS, OR CAUSES BEYOND OUR CONTROL.

 

Under the MCDPA, we and our service providers are required to notify affected Minnesota consumers if their personal information is compromised. We maintain documented contracts with our vendors, obligating them to promptly notify FMSC of any security incident. If you are affected by a security incident, we will notify you without unreasonable delay.

 

If you use our service outside of the United States, you consent to have your data stored within the United States.


VI. DATA RETENTION POLICY, MANAGING YOUR INFORMATION


We will retain your information for as long as you use the service and for a reasonable time thereafter. We may maintain anonymized or aggregated data, including usage data, for analytics purposes. We may retain and use your information as necessary to comply with our legal obligations, resolve disputes, and/or for the period required by laws in applicable jurisdictions. Please note that some or all the information we have collected may be required for the Service to function properly.

 

We retain personal information only as long as necessary to fulfill the purpose for which it was collected, to comply with legal requirements, resolve disputes, enforce our agreements, or as necessary for analytics of internal reporting. Minnesota residents may request deletion of their personal data under the MCDPA. We will erase or anonymize your data unless we are legally required to retain it.

This Privacy Policy applies only to the service. The service may contain links to other websites or apps or may forward users to other websites or apps that we may not own or operate and to which this privacy policy does not apply. The links from the service do not imply that we endorse or have reviewed these websites or apps. The policies and procedures we describe here do not apply to these websites or apps. We neither can control nor are responsible for the privacy practices or content of these websites or apps. We suggest contacting these websites or app providers directly for information on their privacy policies. Nonetheless, we seek to protect the integrity of our service and welcome any feedback about these linked websites and mobile applications. 


VIII. YOUR CHOICES REGARDING YOUR INFORMATION


You have choices regarding the use of information by the service.


Removing Your name from mailing lists


• To remove your name from Haiti Teen Challenge's email lists, email us at info@haititc.org and provide your full name and email address.

• To remove Your name from Haiti Teen Challenge's postal mailing list, please email us at  info@haititc.org and provide your full name and mailing address.

• Please note that it may take 2–4 weeks for your name to be removed from all lists.


Changing Your Information – To change your information, you may email us at info@haititc.org.


Closing Your Account – You may close Your account by contacting us at info@haititc.org. If the email account associated with your email address is not active, we may close your account without notice.


Haiti Teen Challenge does not sell, rent, lease or otherwise share your name, phone number, physical address or email address with third parties except as otherwise provided in our privacy policy. This policy applies to all donor information, whether obtained online or offline.


IX.  INFORMATION COLLECTED FROM OTHER WEBSITES AND MOBILE APPLICATIONS AND DO NOT TRACK POLICY


Your browser or device may offer you a “do not track” option, which allows you to signal to operators of websites, web applications, and mobile applications and services (including behavioral advertising services) that you do not wish such operators to track certain of your online activities over time and/or across different websites or applications. Our service does not support do not track requests at this time, which means that we or our analytics providers or other third parties with which we are working may collect information about your online activity both during and after your use of the service. Haiti Teen Challenge does not sell personal information, nor do we share it with third parties for cross-context behavioral advertising.


X.  CHILDREN


Our service is not intended for children under the age of 18. We do not knowingly collect personal information from an individual under age 18 and by using our services you are certifying that you are over the age of 18. If you are under the age of 18, please do not submit any personal information through the service. If you have reason to believe that we may have accidentally received personal information from an individual under age 18, please contact us immediately at info@haititc.org.


XI.  CHANGES TO PRIVACY POLICY


We reserve the right to update or modify this privacy policy at any time and from time to time without prior notice. Please review this privacy policy periodically, and especially before you provide any information. This privacy policy was made effective on the date indicated above.


If we materially amend this policy to change our use of personal data, particularly as it relates to Minnesota consumer rights, we will post the revised policy and, if you are a Minnesota resident on file with us, send you a notice via email.

We are not a “business” as defined in Section 1798.83 of the California Civil Code; similarly, We do not target or monitor the activities of residents of the European Union. As a non-profit, we have not developed the infrastructure that would be required to respond to requests regarding your information. Nevertheless, if we receive such a request by email at info@haititc.org or by writing to Haiti Teen Challenge, 740 E. 24th St., Minneapolis, MN 55404, that explains why accessing such information is necessary, at our sole discretion, we will consider an appropriate response.
